Could this be considered a criminal offense or a legal matter for a civil suit? I would ask for his removal and make this a part of his permanent record that could potentially keep him out of coaching or teaching for the remainder of his career.

That little kid could have some cervical damage that he doesn't even know about right now. With that blow to his head as young and small as he is , thats worse than Targeting.
